IMPORTANT NOTICE (“NOTICE”)

This website provides you access to [the CHEX [EOS-SOL]/ETH Bridging Protocol] (the “Bridge”).  Your use of the Bridge is subject to the terms of this Notice.  

To the fullest extent permitted by applicable law and except as otherwise specified in a writing by us, (a) the Bridge is provided on an "as is" and "as available" basis without warranties of any kind, and we expressly disclaim all implied warranties as to the Bridge, including, without limitation, implied warranties of suitability, appropriateness, merchantability, fitness for purpose, title and non-infringement; (b) we do not represent or warrant that the Bridge is reliable, current or error-free, meets your requirements, or that defects in the Bridge will be corrected; and (c) we cannot and do not represent or warrant that the Bridge is free of viruses or other harmful components.

We do not provide any advice or recommendation as to your use of the Bridge.  We make the Bridge available to you entirely at your own risk.  We do not act as any facilitator, arranger, counterparty or obligor to any transaction with you on the Bridge including as principal, agent or otherwise.  

By clicking ‘accept’ to this Notice, you represent and warrant that (i) you have read, understand and accept the terms of this Notice; (ii) you have a sufficient understanding of the functionality, usage, storage, transmission mechanisms and other material characteristics of blockchain technology and cryptographic protocols to understand the Bridge and to appreciate the risks and implications of using the Bridge; (iii) you understand, acknowledge and assume the risk associated with using the Bridge (iv) your use of the Bridge complies with applicable law and regulation in your jurisdiction, and any governmental or other consents that may need to be obtained have been and (v) you are not, nor are you an agent for a citizen or resident of a country and that you will not use the Bridge in connection with transactions in any country or with any person that is subject to sanctions or embargoes imposed by the United States, United Kingdom or European Union.  

To the fullest extent permitted by applicable law, you will indemnify, defend and hold us harmless and our respective past, present and future employees, officers, directors, contractors, consultants, equity holders, suppliers, vendors, service providers, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors and assigns from and against all claims, demands, actions, damages, losses, costs and expenses (including attorneys' fees) that arise from or relate to: (i) your use of the Bridge; (ii) any breach of a term of this Notice and/or (iii) your violation of any rights of any other person or entity.
